TERMS & CONDITIONS

By purchasing any of the Twisted U Add-On Packages, you agree to the following terms and conditions.

This is an agreement between you and Twisted U and all of the Twisted U subvendors. The Twisted U agrees to provide key services to you on a specified event date in exchange for your payment of the invoice price.

I agree to treat all vendors and items with respect and not to hold the Twisted U responsible for issues or defects in the items provided.

By signing this contract and agreeing to these terms, I am aligned to the services provided, fees included, items selected and cancellation policy.

Booking: I understand that until I complete this form and submit a form of payment, the Twisted U will not place the order. If not submitted by the cut off time of two weeks before my check-in date, I understand that the items are not confirmed and may not be able to be supplied. We will charge the credit card on file at 72 hours in advance.

Cancellation: I agree to the cancellation policy below and understand that this may limit the amount of money I am refunded depending on the timing of my cancellation.

For Food & Cakes: Cancellations will be accepted 7 days in advance of scheduled appointment time with only the administrative fee being removed (5% due to ecommerce platform). One half of the total balance will be charged for cancellations between 3 to 5 days notice, and the full-service fee will be charged for no-shows and cancellations with less than 72 hours’ notice. 

For Balloons:  Cancellations will be accepted 16 days in advance of scheduled appointment time with only the administrative fee being removed (5% due to ecommerce platform). After that the full-service fee will be charged for no-shows and cancellations with less than 16 days notice due to purchasing of materials and items.

If due to extreme unforeseen circumstances (such as sickness or emergencies) The Twisted U reserves the right to cancel or change your order. If something of this nature is to happen a full refund will be given.

Freshness:
After delivery, it is your sole responsibility to ensure that all food is refrigerated and served in a timely manner. Platters & Cakes can be refrigerated for up to 24 hours. They should remain refrigerated until about 1 hour prior to serving. 

Allergies:
While the Twisted U gladly accepts requests to omit particular foods from its products, we cannot guarantee that any of the products it serves are allergy-friendly as they may be processed or prepared in facilities that also process allergens including nuts, wheat, dairy, and shellfish. This complies to both humans and animals. It is your responsibility to know the allergies and dietary requirements you and your animal needs.

Platters are made to order:
Please be aware that every platter is made carefully by hand. We try our best to use the same products but under some circumstances items may be swapped for similar items and seasonality fruits/veg may vary. 

Liquidated Damages:
In the you are dissatisfied with The Twisted U or any of their sub vendors performance of its obligations contained in this Contract and claims any breach of this Contract and/or claims any breach of duty on the part of The Twisted U or their sub vendors including, but not limited to, claims of negligence, breach of contract, breach of warranty, or any other claim of any kind or sort, the maximum amount you can recover from The Twisted U or subvendors in any suit against The Twisted U and subvendors is the amount you paid to The Twisted U and its subvendors. Under no circumstances will you be entitled to recover any damages from The Twisted U or its subvendors beyond the Contract price.

Emergency Cancellations:
In the event that unforeseen or emergency circumstances outside the control of the parties make it impracticable to uphold this contract, including but not limited to force majeure events, ongoing COVID-19 outbreaks, or an emergency, the parties agree to give notice to one another as soon as possible. You understand that your payment is nonrefundable in these circumstances. If unforeseen or emergency circumstances arise fewer than 7 days prior to the event date, the Client agrees to pay The Twisted U in full despite the emergency.

Venue & Choice of Law:
Any lawsuit with respect to this Contract must be brought in the courts located in Franklin County, Columbus, or the US District Court for the District of Ohio. This Contract is governed and construed in accordance with the laws of the State of Ohio (without regard to its conflict of law provisions).

Privacy Terms of Service: You understand that if you do not opt out, you will be signed up to the Twisted U email service. You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with the Twisted U. Your participation in this program is completely voluntary.
